A guide for landlords faced with distressed or insolvent tenants

There are various options available to landlords faced with distressed or insolvent tenants. The links below have been developed by PwC, with assistance from ourselves, to provide a useful resource for landlords faced with tenants in these situations.

Each link contains information on how the particular insolvency or restructuring procedure might typically evolve, the governance of each process and the remedies normally available to the landlord. Detail to check and information to request is also provided to assist the landlord in each instance.

Please note that the guides are intended as a reference point only and the reader is asked to refer to the specifics of the relevant lease and particular case in each instance.

The restructuring procedure used will depend on where a company is on the corporate demise curve as illustrated by the diagram above. As the company moves down the curve, less options are available and control moves away from it.
