Sewers fall under two different patterns of ownership – public and private.
Private sewers and lateral drains are those that connect a property to a public sewer which is typically the main sewer under the road. It is not well known that generally, private sewers connecting to the public sewer network are the responsibility of the property owner(s) to maintain and uphold.
It is estimated that up to 50 per cent of properties in England and Wales are connected to a private sewer, and there are not always comprehensive records of where private sewers are located or what condition they are in.
In the name of transparency and simplicity, the Government intends to dramatically change the ownership of private sewers by automatically transferring the ownership of them to Water and Sewerage Companies (WaSCs) on 1 October 2011. The regulations bringing about this change are due to be introduced in April 2011.
