Subletting Declaration

A number of the largest commercial property owners in the UK have issued a Declaration on Subletting. At present, commercial property leases, particularly older leases, will often contain a clause which prevents an occupier subletting at market rent. Many landlords have moved away from such a practice in recent years and they felt they wished to set an example to the property industry as a whole. The declaration the BPF members have signed not only seeks to stop restrictions in future leases but, wherever appropriate, to also waive such clauses for existing tenants.

A number of fund managers and professional firms from the legal and surveying professions support what the Declaration is trying to achieve. However, they are bound by the instructions of their clients and therefore do not feel they can be full signatories, but do want to promote the Declaration.
